§ 1 Scope

These Terms of Service apply to the use of the service "Sealix", operated by Julian Biermann, Bleichstraße 52, 67105 Schifferstadt, Germany (hereinafter "Provider").

Sealix is a scheduling coordination service accessible via WhatsApp and the website www.meetsealix.de.

§ 2 Service Description

Sealix enables scheduling coordination via WhatsApp.

The service is currently provided free of charge. The Provider reserves the right to introduce paid features. Users will be informed in advance of any such changes.

§ 3 Requirements for Use

Use of Sealix requires an active WhatsApp account. Use begins with the initial contact to the service and confirmation of opt-in.

Users must be at least 16 years of age. By using the service, the user confirms that they meet this requirement.

§ 4 User Obligations

Users agree to:

use the service only for its intended purpose,
not send any abusive, offensive, or illegal content,
not use the service in an automated manner or in a way that impairs its operation,
only invite persons to groups who have consented to participate.

§ 5 Suspension

The Provider is entitled to temporarily or permanently suspend users who violate these Terms of Service or misuse the service.

§ 6 Availability

The Provider endeavours to provide uninterrupted availability of the service. There is no entitlement to permanent availability. The Provider is not liable for outages caused by force majeure, technical disruptions at third parties, or maintenance work.

§ 7 Liability

The Provider is only liable for damages resulting from intentional or grossly negligent conduct. Liability for slight negligence is excluded unless essential contractual obligations (cardinal obligations) are breached.

The Provider assumes no liability for the accuracy, completeness, or timeliness of content transmitted through the service.

§ 8 Data Protection

§ 9 Termination and Opt-out

Users may terminate their use of the service at any time by sending "STOPP" to the service. This will cease data processing and stored data will be deleted unless statutory retention obligations apply.

The Provider may discontinue the service at any time. Users will be notified in advance.

§ 10 Changes to the Terms

The Provider reserves the right to amend these Terms of Service. Users will be informed of material changes. Continued use of the service after the changes take effect constitutes acceptance.

§ 11 Applicable Law

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this only applies insofar as mandatory provisions of the law of the country in which the consumer has their habitual residence are not overridden.

§ 12 Severability

If any provision of these Terms of Service is or becomes invalid, the validity of the remaining provisions shall not be affected.
